1. Acceptance of Terms

Welcome to WeWiGo. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and WeWiGo Inc. ("WeWiGo," "we," "our," or "us") governing your access to and use of the WeWiGo website, mobile application, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

To use WeWiGo, you must:

  • Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction).
  • If you are between 13 and 18 years old, have the consent of a parent or legal guardian.
  • Have the legal capacity to enter into a binding agreement.
  • Not be barred from using the Service under applicable law.

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at support@wewigo.com if you become aware of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time through the app settings or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Service.

4. Use of the Service

4.1 Permitted Use

WeWiGo grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

4.2 Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Harass, bully, intimidate, or threaten other users.
  • Post or transmit spam, unsolicited advertising, or promotional materials.
  • Upload viruses, malware, or any malicious code.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Scrape, crawl, or use automated means to access the Service without our written consent.
  • Interfere with or disrupt the Service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use the Service in any manner that could damage, disable, or impair the Service.

5. User-Generated Content

5.1 Your Content

"User Content" refers to any text, photos, videos, reviews, itineraries, travel stories, comments, and other materials you create, upload, post, or share through the Service.

5.2 Ownership

You retain all ownership rights to your User Content. However, by posting User Content on WeWiGo, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, display, and create derivative works from your User Content in connection with operating, promoting, and improving the Service.

5.3 Content Standards

User Content must not:

  • Infringe on any third party's intellectual property, privacy, or other rights.
  • Contain false, misleading, or deceptive information.
  • Include defamatory, obscene, pornographic, vulgar, or offensive material.
  • Promote discrimination, hatred, or violence against any individual or group.
  • Contain illegal content or promote illegal activities.
  • Include personal information of others without their consent.
  • Contain commercial solicitations or advertisements without our prior approval.

5.4 Content Moderation

We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, without prior notice, for any reason, including but not limited to violations of these Terms. We are not responsible for any User Content posted by users.

5.5 Content Removal Requests

If you believe any content on the Service infringes your rights, please contact us at legal@wewigo.com with a detailed description of the alleged infringement.

6. Subscription Plans and Payments

6.1 Free and Paid Plans

WeWiGo offers a free tier ("Explorer") and paid subscription plans ("Adventurer" and "Globetrotter"). Paid plans provide access to additional features as described on our Pricing page.

6.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize us to charge the applicable fees to your designated payment method.

6.3 Free Trials

We may offer free trial periods for paid plans. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires.

6.4 Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice of any price increase. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6.5 Refunds

Subscription fees are generally non-refundable. However, refund requests may be considered on a case-by-case basis. For refund inquiries, contact billing@wewigo.com.

6.6 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

7. Advertising

The free tier of WeWiGo is supported by advertisements, including ads served by third-party networks such as Google Ads and Google AdMob. By using the free tier, you agree to the display of advertisements within the Service. Paid subscribers enjoy a reduced or ad-free experience as described in their plan details.

We are not responsible for the content of third-party advertisements. Your interactions with advertisers, including any purchases, are solely between you and the advertiser. For more information on how ads work and how to manage your preferences, see our Privacy Policy.

8. Intellectual Property

8.1 Our Property

The Service, including its design, text, graphics, logos, icons, images, software, and all other content (excluding User Content), is the property of WeWiGo or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Trademarks

"WeWiGo," the WeWiGo logo, and all related names, logos, and slogans are trademarks of WeWiGo Inc. You may not use these trademarks without our prior written consent.

8.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

9. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, services, or applications, including booking platforms, maps, and payment processors. These third-party services are governed by their own terms and privacy policies. We do not endorse, control, or assume responsibility for any third-party services.

Your use of third-party services is at your own risk. We encourage you to review the terms and privacy policies of any third-party services you access through WeWiGo.

10. Travel Information Disclaimer

WeWiGo provides travel-related information, including destination guides, user reviews, itinerary suggestions, and cost estimates, for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any travel information on the Service.

You are solely responsible for:

  • Verifying travel requirements, including visas, vaccinations, and entry restrictions.
  • Ensuring your personal safety during travel.
  • Making informed decisions based on your own research and judgment.
  • Purchasing adequate travel insurance.

WeWiGo is not a travel agency and does not assume responsibility for your travel arrangements, experiences, or outcomes.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • The results obtained from the Service will be accurate or reliable.
  • Any defects in the Service will be corrected.
  • The Service will meet your specific requirements.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEWIGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless WeWiGo and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Service.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of any rights of another party.
  • Your travel activities or decisions.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

14.2 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in San Francisco, California.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive your right to participate in a class action lawsuit or class-wide arbitration.

14.4 Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and where appropriate, sending you a notification through the Service or via email. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and WeWiGo regarding the Service.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
